Banning Aarakshan is denial of freedom

We are once again witnessing State Governments tripping over each
other to ban a film in the hope of deriving political mileage -- a
hope based on the astounding presumption that the people must be
treated as chattel and denied the freedom to watch films and read
books of their choice lest they be led astray. What is more worrisome
for Governments, both in New Delhi and in the States, is that
allowing unfettered access to books and films runs the risk of
realisation dawning upon the masses that they have been misled into
believing that deliverance lies in blindly following politicians who,
much like the Pied Piper of Hamelin, have been leading us from light
unto darkness.

This article is not being written in praise of Prakash Jha's latest
film, Aarakshan; rarely, if ever, has this columnist offered a
critical view of films, not the least because he is neither a movie
buff nor tutored in the fine art of film criticism. But this article
is definitely in defence of Prakash Jha's right to produce, direct
and screen a film that has been cleared by the Censor Board of India
as is required under the law of the wondrous land in which we live. A
ban on the screening of Aarakshan, even if it is limited to three
States (till now), therefore, reflects callous disregard for the law
and the contempt with which legally established practices are held by
politicians who are too cynical to distinguish right from wrong. It
also stifles, in a certain sense, a wider debate on the policy of
caste-based (or gender-based and religion-based) reservations that
has been thrust upon us by politicians who seek nirvana by following
a path that runs diagonally opposite to the one that was shown by the
Constituent Assembly and charted in the Constitution of India.

It may be politically incorrect to oppose the ban on Aarakshan
imposed by the Governments of Uttar Pradesh, Andhra Pradesh and
Punjab, but this column has not been known to be politically correct
in the past. Hence, there is every cause to reiterate, unambiguously,
that the ban on this film amounts to gross denial of Prakash Jha's
right to free speech and expression guaranteed by Article 19(1)(a) of
the Constitution which, we can be quite sure, is an alien and
abhorrent text for our politicians. It is a sad commentary on the
state of freedom in India that such denial should be officially
sanctified on the eve of the nation's 65th Independence Day; we may
be a free nation, but we are yet to achieve freedom of thought and
expression, the right to hold and publicly state an opinion that
could run counter to a prevalent opinion or militate against
conventional (and convenient) wisdom.

It is in this context that the petition filed by Prakash Jha in the
Supreme Court, challenging the ban on his film, gathers greater
importance. The petition rightly "raises an important question of law
as to whether Article 19(1)(a) of the Constitution of India can be
obliterated or trampled upon by State Governments by prohibiting the
exhibition of a film only to support a political view". The Supreme
Court should have taken up the petition for immediate hearing instead
of listing it for next week; lesser and more frivolous causes have
found greater favour with the judiciary in the past.

For not only has the ban on Aarakshan diminished the authority of the
Censor Board of India, it has also repudiated several judgements
setting aside similar politically expedient orders proscribing books
and films. In fact, two separate High Courts have cleared Prakash
Jha's film for screening; their orders stand rudely snubbed. More
specifically, as pointed out by this newspaper, in 1989 the Supreme
Court cleared the screening of a Tamil film that raised discomfiting
questions about the caste-based reservation policy. The court had
then said, "Movie is the legitimate and the most important medium in
which issues of general concern can be treated. The producer may
project his own messages which the others may not approve of. But he
has a right to 'think out' and put the counter appeals to reason. It
is a part of a democratic give-and-take to which no one could
complain. The state cannot prevent open discussion and open
expression, however, hateful to its policies."

But it is not fair to blame authority alone for taking recourse to
proscription to keep books and films out of the public domain. Often
such demands have emanated from specific communities and have been
pandered to. Some years ago this column had commented on how a book,
an essay and a film had run into trouble almost concurrently. The
Bundelas, to use a cliche, were up in arms against London-based
author Jaishree Misra and wanted the Union Government to impose a ban
on her novel, Rani, a fictional account of the life and times of Rani
Lakshmibai published by Penguin. The book was promptly banned in
Uttar Pradesh where politicians, not known for either rectitude or
probity, feigned moral outrage over Jaishree Misra's audacious
suggestion that Rani Lakshmibai, immortalised in folklore as the
chaste and brave Jhansi ki Rani, had an affair with Robert Ellis, the
British political agent. As for the Bundelas, they were further
incensed that the author should have claimed Raja Gangadhar Rao was
impotent. MM Kaye was wise not to identify the dissolute raja in her
bestseller (later made into a blockbuster television serial) The Far
Pavilions, as was JR Ackerley, who displayed amazing inventiveness
while fudging the identity of the degenerate ruler in his Hindoo
Holiday -- An Indian Journal.

The demand to ban Rani, however, was largely peaceful, unlike the
agitation against the inclusion of "Three Hundred Ramayanas: Five
Examples and Three Thoughts on Translation", an essay by AK
Ramanujam, in the recommended reading material for students of
history in Delhi University. Enraged members of the ABVP ransacked
the university's Arts Faculty. The ABVP insisted Ramanujam, an
acclaimed scholar of the Ramayana tradition, had "defamed" Ram. As an
activist put it, "It goes against everything we have been taught as
children. What is the point of applying logic to religion? It is a
matter of faith." Allowing belligerence to get better of reason, the
ABVP activists missed out on two points. First, Ramanujam had
referred to the various Ramayana traditions; rubbishing him and
trashing his essay would mean repudiating the existence of these
traditions. Second, the essay was an academic exploration and had
nothing to do with either religion or logic.

Often our, as also our Government's, response to that which we
perceive to be offensive is no more than knee-jerk reaction. A case
in point is the hostility with which the Rajput Sabha greeted
Ashutosh Gowarikar's film, Jodhaa Akbar. The film was based on an
alleged 'episode' of history, which by all accounts and available
records of the period never really happened. It was a frivolous film
that sought to dazzle viewers rather than recreate Akbar's foray into
Rajputana. But it was up to the people to either watch the film or
give it a pass. Similarly, the choice of watching or boycotting The
Da Vinci Code should have been entirely that of the people; State
Governments had no business to ban the film. Prakash Jha may have
made a film that merits notice, or it could be eminently forgettable.
That, however, is irrelevant. What is relevant is his right to screen
Aarakshan and let people decide its worth or otherwise.

Dalits from Punjab had demanded the lifting the ban on movie
reservation. Movie on life of Ravidas did not allow by hindus in UP
and in varanashi where Ravi dass was born.

ban !!!!!!! In Punjab where more than 31 percent of the 2.77 crore
population belongs to the weaker sections, including the Scheduled
Castes. The state government had imposed a ban on the film Thursday
following intelligence reports that it could lead to social
disturbance. The observing committee have even listed the positive
aspects of the film.

Freedom of expression is meaningless without consideration to extent
of reach

Kanchanji there is a problem with your argument! I have freedom of
speech etc etc but I do not have the reach, for instance, you have.
How do you suggest we deal with who have capacity to influence public
opinion start writing fictions/fantasies irresponsibly or with
ulterior motives? Advertisements are pushed as news, opinion is
pushed as news almost every crap by those who have reach, influence
people. Freedom of expression is meaningless without consideration to
extent of reach.

Aarakshan mercilessly exploits prejudices against SC/ST/OBC for
commercial gains. The film crew maintained false notion that it is
about reservation & misguided society into a debate which is not
there in it & created panic. Rather it deals with conflict among
privileged caste Khatriya, Viashya & Brhamin. Such exploitation is
irresponsible from the part of filmmaker, producer & film's unit.

I would like to say that the amount of influence the Indian state has
on the day to day lives of people is phenomenal. It should be up to
the people to decide the correct amount of influence and the state
has no right to tell them what and what not to watch.
